At TV Nostalgia, we offer merchandise featuring unique designs. These designs are provided by Under20 Media LLC and are licensed to us under specific terms that ensure compliance with copyright law, including the fair use doctrine.
Many of the designs are transformative works, such as parodies, cartoons, and drawings, which qualify as fair use under U.S. copyright law (17 U.S.C. § 107) due to their new expression, meaning, or purpose. As established in the U.S. Supreme Court decision Campbell v. Acuff-Rose Music, Inc. (1994), transformative works are lawfully protected under fair use, even when used commercially.
Additionally, Under20 Media LLC further modifies pre-existing fair use works, creating new transformative designs. In accordance with Blanch v. Koons (2006), successive transformations—like those made by Under20 Media LLC—are also protected by fair use, provided they add substantial new meaning or aesthetic content.
Under this framework, the designs offered by TV Nostalgia, both original and modified, are legally protected. Under20 Media LLC assumes all legal responsibility for these designs, including any claims related to copyright or trademark disputes. TV Nostalgia is not liable for any legal issues arising from the use of these designs.
